Welcome to ABA Fieldwork Tracker. These Terms of Service ("Terms") govern your access to and use of the website at abafieldworktracker.com and the ABA Fieldwork Tracker web application (collectively, the "Service"), operated by ABA Fieldwork Tracker ("we," "us," or "our").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Overview of the Service
ABA Fieldwork Tracker is a compliance-focused fieldwork hour tracking platform designed for individuals pursuing Board Certified Behavior Analyst (BCBA) or Board Certified Assistant Behavior Analyst (BCaBA) certification through the Behavior Analyst Certification Board (BACB). The Service provides:
- Fieldwork hour logging with 5-category allotment tracking
- Real-time compliance validation across 8 BACB certification pathways
- Certification progress dashboards with compliance gauges
- Supervisor oversight dashboards with read-only trainee access
- BACB-ready PDF report generation
- Enterprise audit trail and organizational management features
- Supervisor-trainee connection system
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
3. Account Registration
- You must provide accurate, complete, and current information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
- You must notify us immediately if you suspect unauthorized access to your account.
- We reserve the right to suspend or terminate accounts that contain false or misleading information, or that violate these Terms.
4. Acceptable Use
You agree to use the Service only for its intended purpose — tracking BACB fieldwork hours and related compliance activities. You agree not to:
- Log false, fabricated, or misleading fieldwork hours or data.
- Use the Service to misrepresent your certification progress to the BACB, supervisors, employers, or any other party.
- Access or attempt to access another user's account without their explicit authorization.
- Reverse-engineer, decompile, disassemble, or attempt to extract the source code of the Service.
- Use automated bots, scrapers, or other tools to access the Service.
- Transmit viruses, malware, or any other malicious code through the Service.
- Use the Service to store or transmit Protected Health Information (PHI), patient data, or any individually identifiable health information.
- Interfere with or disrupt the integrity or performance of the Service.
- Violate any applicable local, state, national, or international law or regulation.
5. Data Accuracy and Your Responsibilities
Important: ABA Fieldwork Tracker is a tracking and compliance-monitoring tool. While we validate your data against known BACB rules in real time, you are solely responsible for the accuracy and truthfulness of all fieldwork hours and data you enter. The Service does not replace the professional judgment of your supervisor or the official requirements of the BACB.
- You are responsible for ensuring all logged hours accurately reflect actual fieldwork completed.
- Compliance indicators provided by the Service are based on the BACB rules as we understand them at the time. While we strive for accuracy, we do not guarantee that our compliance engine reflects the most current BACB requirements at all times.
- You should always verify your compliance status directly with the BACB and your supervising BCBA before submitting certification applications.
- We are not liable for certification denials, delays, or other consequences arising from inaccurate data entered by users or discrepancies between our compliance engine and current BACB rules.
6. Supervisor and Organization Features
6.1 Supervisor Connections
- Trainees may invite supervisors (and vice versa) to establish a connection within the Service.
- Once connected, supervisors receive read-only access to the trainee's fieldwork dashboard, hours, compliance data, and reports. Supervisors cannot modify trainee data.
- Either party may revoke a connection at any time. Upon revocation, the supervisor's access to that trainee's data is immediately terminated.
- Connection invitations expire automatically (email invites after 7 days, link invites after 1 hour) for security purposes.
6.2 Organization Accounts
- Organizations that adopt the Service for their employees agree that designated administrators may access aggregate compliance data and audit logs for users within their organization.
- Organization administrators are responsible for ensuring their use of the Service complies with all applicable employment and privacy laws.
- Individual users within an organization retain all rights described in these Terms, including the right to export their own data.
7. Your Data and Ownership
You own your data. All fieldwork hours, compliance data, reports, and other content you create within the Service remains your property. We claim no ownership rights over your data.
- Export: You may export your data at any time in standard formats (CSV, PDF) from within the Service. There is no vendor lock-in.
- License to Us: By using the Service, you grant us a limited, non-exclusive license to store, process, and display your data solely for the purpose of providing the Service to you. This license terminates when you delete your account.
- Aggregate Data: We may use anonymized, aggregated data (which cannot identify you) to improve the Service, generate industry insights, or for research purposes.
- Deletion: You may request permanent deletion of your account and all associated data. See our Privacy Policy for details on data retention and deletion procedures.
8. Intellectual Property
- The Service — including its design, code, logos, trademarks, documentation, and all visual and functional elements — is the intellectual property of ABA Fieldwork Tracker and is protected by applicable copyright, trademark, and other intellectual property laws.
- You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
- "ABA Fieldwork Tracker," "ABA FT," and associated logos are trademarks of ABA Fieldwork Tracker. You may not use these marks without our prior written permission.
- "BACB," "BCBA," "BCaBA," and "RBT" are trademarks of the Behavior Analyst Certification Board, Inc. We are not affiliated with, endorsed by, or sponsored by the BACB.
9. BACB Disclaimer
ABA Fieldwork Tracker is an independent, third-party tool. We are not affiliated with, endorsed by, certified by, or in any way officially connected with the Behavior Analyst Certification Board (BACB). All BACB-related terms and certification pathway information are used for informational and compliance-tracking purposes only. Always refer to the official BACB website for the most current certification requirements.
10. Service Availability and Modifications
- We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance, and the Service may be temporarily unavailable due to factors beyond our control.
- We reserve the right to modify, update, or discontinue any feature of the Service at any time. For material changes that significantly affect your use of the Service, we will provide reasonable advance notice.
- If we discontinue the Service entirely, we will provide at least 90 days' notice and ensure you can export all of your data before shutdown.
11. Pricing and Payment
The Service is currently offered free of charge during our launch period. If we introduce paid plans in the future:
- Existing users will receive advance notice of at least 30 days before any pricing changes take effect.
- We will clearly communicate what features are included in free versus paid tiers.
- You will never lose access to your existing data, regardless of your payment status.
12. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not warrant that the Service will be error-free, secure, or uninterrupted, or that any defects will be corrected.
- We do not warrant that the compliance calculations, BACB rule interpretations, or certification pathway information provided by the Service are complete, accurate, or current at all times.
- In no event shall ABA Fieldwork Tracker, its owners, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or loss of certification opportunities, arising from your use of or inability to use the Service.
- Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us (if any) in the 12 months preceding the claim, or $100, whichever is greater.
13. Indemnification
You agree to indemnify, defend, and hold harmless ABA Fieldwork Tracker and its owners, employees, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Any inaccurate, false, or misleading data you enter into the Service
- Your infringement of any third party's rights
14. Termination
- By You: You may stop using the Service and request account deletion at any time by contacting us. Upon deletion, your data will be handled in accordance with our Privacy Policy.
- By Us: We may suspend or terminate your access to the Service if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. Where possible, we will provide notice and an opportunity to export your data before termination.
- Effect of Termination: Upon termination, your right to use the Service ceases immediately. Sections 5, 7, 8, 9, 12, 13, and 16 survive termination.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page, updating the "Last Updated" date, and — for significant changes — sending an email notification to active account holders. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
16. General Provisions
- Governing Law: These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles.
- Dispute Resolution: Any disputes arising from these Terms or the Service shall first be addressed through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Florida.
- Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and ABA Fieldwork Tracker regarding the Service.
- Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
- Assignment: You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations without restriction.
